Key DocumentsSTATE OF TEXAS § COUNTY OF LAMB § AFFIDAVIT OF MARY DAVILA WOOD 1. My name is Mary Davila Wood. I am more than twenty-one (21) years of age, of sound mind, and am wholly competent to sign this Affidavit. I have personal knowledge of the facts stated in this Affidavit, and they are true and correct. 2. I testified in the capital murder trials of Jesus Ramirez and Alberto Sifuentes. I have been asked why I testified that I thought that we had stopped at the Jolly Roger store the night of the murder. Here is what I recall. 3. When we left the club in Lubbock, I remember that I was sitting in the front seat of the car in between Jesus Ramirez (who I knew as Manuel) and Alberto Sifuentes (who I knew as Gilbert). I remember going over train tracks and then I fell asleep or passed out. I had been drinking beer and mixed drinks during the day and that night at the bar. 4. The next thing that I remember was seeing yellowish or orangish lights and the side of a brick building. I also remember looking to my left and seeing gas pumps. I also remember hearing a car door close and paper rattling. I remember thinking at the time that we must still be Lubbock. I remember that the car started moving and I then leaned back against the seat. It is my recollection that shortly after seeing the lights and hearing the car door close and paper rattling that we were stopped by Buddy and another police officer on the highway on our way to Sudan. 5. I never saw any guns that night. I never heard a gunshot. I never saw any blood or a change of clothes. Jesus Ramirez and Alberto Sifuentes never changed their clothes that night. I never heard Jesus Ramirez or Alberto Sifuentes say anything that night about the Jolly Roger store, a murder or shooting, or robbing a convenience store. 6. I was questioned by the Texas Rangers and other police officers and by the prosecutors several times during the two years between the murder and the trials. From the first time that I met with the Ranger Sal Abreo and another Texas Ranger, they were in my face, yelling at me and calling me a liar. They accused me of knowing about the murder and holding back information about it. The Texas Rangers told me that I needed to say that I saw Ramirez and Sifuentes with a gun that night and that we drove down a dirt road and the men threw the gun away. I repeatedly told them that I never saw a gun and we never drove down a dirt road. The police also told me that if I would cooperate with them, I would not be prosecuted. 7. At some point, Sal Abreo drove me by the Jolly Roger store in Littlefield. He told me that he was going to take me to the scene of the crime to see if would remember anything. He never took me to look at any other convenience stores in the area. I told Abreo that I remembered seeing yellowish lights, gas pumps and a brick building. I told him that I never saw a Jolly Roger sign, or any other sign on the building. Ranger Abreo parked on the side of the Jolly Roger building, and I could see that there was a door and some windows on the side of the building. I told him that I did not remember seeing a window or door on the side of the building that I saw that night. When I said this, Abreo told me that the window and door may not have been there before because the store was being remodeled. 8. After testifying before the grand jury, I was shown autopsy pictures of the women who had been killed and pictures of her family. The police and prosecutors again told me that I was not being truthful. They kept asking me to tell them where the gun was. They promised to give me money and a new identity if I told them where the gun was. I told them that I could not tell them where the gun was because I did not know anything about a gun. 9. The police and prosecutors were always wanting me to tell them what time certain things took place the night of the murder. I told them I did not know any times because I never pay attention to the time. I could just tell them what I remembered happening that night, The police and prosecutors were always trying to tell me what time certain things happened. When I was asked to say what time things happened that night, I had to guess and often said the times that were suggested to me. 10.I told police and prosecutors that I went with Jesus Ramirez and Alberto Sifuentes to a bar in Lubbock that night. I had not been to a bar for several years before that night. When we got to the bar in Lubbock, we sat down at a table to have some drinks. That night there was a band playing. During the night, there were several people in the bar. The pool table area was full of people. The seats along the bar were filled with people, and there were people sitting at the tables around us. While we were at the bar, a woman came over and talked to Jesus. She called him Jesse. She was Hispanic with a lighter complexion and blonder or lighter-colored hair. I did not know the woman, but Jesus told me that she used to be his girlfriend. I remember telling the police about this woman at the bar. 11.I remember that we were at the club when it was closing. I remember that the band stopped. playing and they were packing up to leave. I also remember the lights coming on at the bar, like it was last call. I remember staying to finish the beer that I had. at the table after the lights came on and the band had stopped playing. After finishing my beer, we left the bar. FURTHER, Affiant sayeth not.
